Firm's Environmental Practice Head To Lead DC Bar Program
Jim Witkin, the head of Linowes and Blocher's Environmental Practice Group will be moderating a roundtable discussion, "The All Appropriate Inquiries (AAI) Standard: Doing Environmental Due Diligence the Right Way in Real Estate Transactions," for an upcoming District of Columbia Bar program.
This brown-bag lunch program will be held Monday, March 19 from 12:00 - 1:30 pm at the D.C. Bar Conference Center in downtown Washington, D.C.
The EPA's new All Appropriate Inquiries (AAI ) rule took effect in November, 2006, and now governs the protocols for performing environmental due diligence in many commercial real estate transactions. The 2002 Brownfields Amendments to the federal Superfund law provided broadened environmental liability protections, but only to parties who comply with the AAI standards. This seminar will examine the AAI rule (and the related ASTM standards for Phase I environmental site assessments) from the legal, technical and practical perspectives.
The panelists will discuss the following topics:
- How the new standards differ from the pre-AAI standards
- How participants in real estate transactions can ensure compliance with the new rules
- The role of environmental consultants in the AAI process
- When compliance with the standards may not be appropriate
- Alternative due diligence standards
Jim Witkin will moderate and serve as a panelist alongside Patricia Overmeyer , US Environmental Protection Agency, and Thomas R. VanBlaricom , President, Environmental Consultants and Contractors.
